Abstract

The discussion in this article centers on legal validity for a man (wali) to stop a woman under his guardianship from getting married to a suitable match. The aim of the study is to point out the causes of woman’s celibacy so that it can be avoided. The researcher’s goal is to clarify the legal position of a guardian who forces a woman to lead her life as a celibate and stop her from marrying a suitable spouse. The findings show that celibacy has been discouraged in Islam as it deprives women from marrying or choosing their happy union. If she is deprived of her this right, it might lead her to involve in crimes or even to commit suicide because she will not able to fulfill her genuine desire of having a family. In this article, the guardians would find some advice so that they do not deprive the women under their guardianship from a compatible and desirable spouse which would lead to a satisfactory union.
